Advice from Our Landlord Tenant Law Experts Serving Dover, Rochester & Wakefield, NH

No matter if you are a tenant that is being treated unfairly by a landlord or you are a landlord that is being taken advantage of by a tenant, there comes a time when legal action may be necessary. Although we all hope to get along with our tenants or landlords, there are times were unreasonable demands are being made and cannot be resolved amicably. Should you be in a similar situation and are wondering when the right time is to seek legal action, we ask that you read on. In this blog, we will provide you with several examples that will give you a better understanding of when to seek legal help.

Landlord is refusing to make repairs

One of the most common lawsuits that takes place is when a landlord is unwilling to make repairs to your home/apartment and it is creating an unsafe living space for your family. Although there may be some instances where repairs cannot be immediately completed, an experienced lawyer will be able to ensure repairs are made if this is a longstanding issue that is leaving you or your family open to potential harm or injury.

Landlord is unwilling to pay back security deposit

Once you have completed your lease with your landlord, they are expected to give you back your security deposit if you left the home in proper condition. If you feel that you did this, and the landlord is unwilling to pay back the deposit, you can seek legal action to get what you deserve. If it is determined that you cared for the home or apartment as agreed upon, you will be awarded your deposit.

The tenant has not paid rent or has damaged property

When a tenant is unwilling to pay their rent for an extended period of time or has created significant damage to your property, a landlord is able to seek restitution through the courts. If it can be shown that you have made several attempts to collect money and/or the tenant has purposely caused damaged to the property, you will be able to get what is rightfully yours in most cases.
